Third Parties

To transfer personal information to a third party acting as a controller, organizations must comply with Privacy Shield’s Notice and Choice Principles.

Medialocate also enters into contracts with third-party controllers that provide that such data may only be processed for limited and specified purposes consistent with the consent provided by the individual and that the recipient will provide the same level of protection as the Principles and will notify the organization if it makes a determination that it can no longer meet this obligation.  The contract shall provide that when such a determination is made the third party controller ceases processing or takes other reasonable and appropriate steps to remediate.

To transfer personal data to a third party acting as an agent, Medialocate shall: (i) transfer such data only for limited and specified purposes; (ii) ascertain that the agent is obligated to provide at least the same level of privacy protection as is required by the Principles; (iii) take reasonable and appropriate steps to ensure that the agent effectively processes the personal information transferred in a manner consistent with the organization’s obligations under the Principles; (iv) require the agent to notify the organization if it makes a determination that it can no longer meet its obligation to provide the same level of protection as is required by the Principles; (v) upon notice, including under (iv), take reasonable and appropriate steps to stop and remediate unauthorized processing; and (vi) provide a summary or a representative copy of the relevant privacy provisions of its contract with that agent to the Department upon request.

Choices You Have About How MediaLocate Uses Your Information

You have the following data protection rights:

  1. To access, correct, update or request deletion of your Personal Information. Medialocate takes reasonable steps to ensure that the data we collect is reliable for its intended use, accurate, complete, and up to date. You may contact us directly at any time about accessing, correcting, updating or deleting your Personal Information, or altering your data, by submitting a request to us at webmaster@medialocate.com. We will consider your request in accordance with applicable laws.
  2. In addition, if you are a resident of the EEA, you can object to processing of your Personal Information, ask us to restrict processing of your Personal Information or request portability of your Personal Information.   3. You have the right to complain to a data protection authority about our collection and use of your Personal Information. For more information, please contact your local data protection authority.
  4. As described above, for much of the Personal Information we collect and process about Contacts through the Services, we act as a processor on behalf of our Customers. In such cases, if you are a Contact and want to exercise any data protection rights that may be available to you under applicable law or have questions or concerns about how your Personal Information is handled by Medialocate as a processor on behalf of our individual Members, you should contact the relevant Member that is using the Medialocate services, and refer to their separate privacy policies.

If you no longer want to be contacted by one of our Members through our Services, please unsubscribe directly from that Member’s newsletter or contact the Member directly to update or delete your data. If you contact us directly, we may remove or update your information within a reasonable time and after providing notice to the Member of your request.

How MediaLocate Protects Your Information

We work hard to protect your personal information. We use both technical and procedural methods to maintain the integrity and security of our databases, including firewalls, passwords and other security controls.

Rights of Individuals

Under California Law, users of our services California have the right to request in writing from businesses with whom they have an established business relationship, (a) a list of the categories of Personal Information, such as name, email, and mailing address, and the type of services provided to the customer that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third-parties’ direct marketing purposes, and (b) the names and addresses of all such third parties. The availability of binding arbitration shall be determined in accordance with ICDR-AAA EU-U.S. Privacy Shield Annex I Arbitration Rules (Effective as of September 15, 2017)

Medialocate may be required to disclose information to any competent law enforcement body, regulatory body, government agency, court or other third party where we believe disclosure is necessary (a) as a matter of applicable law or regulation, (b) to exercise, establish, or defend our legal rights, or (c) to protect your vital interests or those of any other person.

Accountability for Onward Transfer

MediaLocate complies with the Notice and Choice Principles in the event of any transfer of personal information to third parties who are either controllers or agents. In each such instance, Medialocate by contract limits the utilization of all such transfers to the direct purpose for which the disclosure has been consented to by the source.  Onward transfers, whether to controllers or agents, are limited to only those counterparties who have agreed to protect such information to at least the same degree that Medialocate is bound by the Principles.  Third parties are also required to notify Medialocate in the event that they are not capable of meeting such standard.  Should such occasion arise, the counterparty is contractually required to discontinue processing the information and shall take all steps necessary to remediate the deficiency until it can comply with the Principles.
